VivaMama Terms of Use

1. About VivaMama

VivaMama is a postpartum wellness and education companion for new mothers. The App offers educational content, an AI companion for general information and emotional support, weekly self check-ins, a wellness reflection score for personal use, access to peer community features, the ability to book consultations with independent healthcare professionals, and suggestions of postpartum products through third-party affiliate links.

VivaMama is not a medical device. The App does not diagnose, treat, cure, or prevent any medical condition. The App is not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any medical concern. In case of a medical emergency, contact your doctor or local emergency services immediately.

2. Eligibility

You must be at least 18 years old and legally competent to enter into a binding contract to use the App. By using the App, you confirm that you meet these requirements.

3. Nature of the Services

All content, AI responses, wellness reflection scores, suggested products, weekly check-in feedback, and care navigation suggestions provided through the App are for educational and informational purposes only. They do not constitute medical advice, diagnosis, treatment, or a clinical evaluation of any kind.

4. Independent Healthcare Professionals

The App allows you to book consultations with independent healthcare professionals such as obstetricians, paediatricians, dietitians, physiotherapists, lactation consultants, and licensed mental health professionals. Any clinician-patient or practitioner-client relationship is established directly between you and the independent professional you consult. Wellness Emporio India Private Limited is not a party to that relationship and does not provide medical advice, diagnosis, or treatment itself. Independent professionals are solely responsible for the clinical care they provide.

5. AI Companion

The App includes an AI Companion that provides general educational information and emotional support. AI responses are generated by software, may contain errors, and must not be relied upon for any medical decision. The AI Companion does not diagnose, treat, or provide personalised medical advice. For any health concern, please consult a qualified healthcare professional.

6. Wellness Reflection Score and Check-ins

The Viva Recovery Score and the weekly check-ins are self-reflection tools intended for your personal use. They do not constitute a medical assessment, diagnosis, or clinical evaluation. Suggestions you receive based on your check-ins are general and educational in nature, not personalised medical advice. Please consult a qualified healthcare professional for any health concern.

7. Care Manager

The Care Manager is a non-clinical support coordinator who helps you navigate resources, schedule consultations, and access content within the App. The Care Manager does not provide medical advice, diagnosis, or treatment. For any medical question, please consult a qualified healthcare professional.

8. Subscriptions and Payments

Certain features of the App require a paid subscription. By subscribing, you authorise us and our payment partners to charge the applicable fees through your selected payment method. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your Google Play account settings. Refunds are governed by Google Play's refund policy and applicable law. Free trials, where offered, convert automatically to a paid subscription unless you cancel before the trial ends.

9. Affiliate Program Disclosure

VivaMama participates in the Amazon Associates Program and may receive a commission when you purchase products through links in the App. Product suggestions are for your convenience only and are not medical recommendations. Please consult a qualified healthcare professional regarding any product that may affect your health, including products used during the postpartum period, while breastfeeding, or that may interact with medication.

10. User Content

You may submit posts, comments, feedback, photographs, or other content through the community and other features of the App (User Content). You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, royalty-free licence to host, display, and use that content within the App for the purpose of providing the Services. We will not use your personal User Content for external marketing without your separate explicit consent.

11. Prohibited Conduct

You agree not to use the App to share unlawful, abusive, defamatory, or misleading content; to upload viruses or malicious code; to harass other users or professionals; to use automated tools to scrape data; to misrepresent your identity; or to attempt to interfere with the operation of the App.

12. Intellectual Property

All content, design, software, branding, and tools within the App, other than User Content and third-party content, are the property of Wellness Emporio India Private Limited. You are granted a limited, personal, non-transferable, non-exclusive licence to use the App for personal, non-commercial purposes only.

13. Third-Party Services and Links

The App integrates with and links to third-party services. We are not responsible for the content, safety, products, or privacy practices of any third party. Your use of any third-party service is governed by that party's own terms and policies.

14. Limitation of Liability

To the maximum extent permitted by law, Wellness Emporio India Private Limited and its directors, employees, and partners are not liable for any direct, indirect, incidental, consequential, or special damages arising from or relating to (a) your use of or inability to use the App, (b) any advice, opinion, or treatment provided by an independent healthcare professional accessed through the App, (c) any content, product, or service accessed through a third-party link including affiliate links, (d) any response generated by the AI Companion, (e) any reliance you place on the wellness reflection score, check-ins, or content, or (f) any technical interruption to the Services.

15. Termination

You may stop using the App and request deletion of your account at any time by writing to the Grievance Officer at the contact below. We may suspend or terminate your access to the App if you violate these Terms or misuse the Services.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the App or by email at least 7 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts in Noida, India.
